General Rules for Competitions on Facebook and Instagram
I. General Provisions

- Details of each specific competition, in particular its duration, method of participation, method of selecting the winner and the prize, are always specified in the relevant competition post (hereinafter referred to as the “Competition Post”). These General Rules together with the Competition Post constitute the complete rules of the specific competition. In the event of any discrepancy between these General Rules and the Competition Post, the conditions stated in the Competition Post shall prevail.
- Participation in the competition is free of charge and is not conditional upon the purchase of any goods or services, unless expressly stated otherwise for a specific competition in accordance with applicable law.
- The competition is in no way sponsored, endorsed, administered by or associated with Facebook. Facebook is not responsible for the conduct of the competition. By participating in the competition, the participant acknowledges that all information relating to the competition is provided to the Organiser and not to Facebook and, to the extent permitted by applicable law, releases Facebook from any liability arising in connection with the competition.
- The competition is in no way sponsored, endorsed, administered by or associated with Instagram. Instagram is not responsible for the conduct of the competition. By participating in the competition, the participant acknowledges that all information relating to the competition is provided to the Organiser and not to Instagram and, to the extent permitted by applicable law, releases Instagram from any liability arising in connection with the competition.
- All questions, comments or complaints concerning the competition must be addressed to the Organiser and not to Facebook or Instagram.
II. Conditions of Participation
- The competitions are open to individuals aged 18 or over who have an active Facebook or Instagram account and meet the conditions specified in the relevant Competition Post.
- Only a participant with a delivery address in the Czech Republic may become a winner, unless otherwise stated in the Competition Post.
- Employees of the Organiser and persons close to them within the meaning of Section 22 of Act No. 89/2012 Coll., the Civil Code, are excluded from participation in the competition. If a person who does not meet the conditions of participation is selected as a winner, the prize will not be awarded to that person and the Organiser shall be entitled to select an alternative winner.
- A participant enters the competition in the manner specified in the relevant Competition Post, for example by adding a comment, reacting to the Competition Post or submitting a photograph or other content.
- Participants may not use fake accounts, automated tools or other methods intended to unfairly increase their chances of winning.
- Participation in a competition on Facebook shall not be conditional upon sharing the Competition Post on the participant's personal timeline or another person's timeline, nor upon tagging people in a manner contrary to Facebook's platform rules.
- If the competition requires the submission of a photograph, video or other content, the participant is responsible for ensuring that they are entitled to use such content and that its publication does not infringe the rights of third parties, in particular copyright or personality rights.
- The start and end dates of each specific competition are always stated in the Competition Post.
III. Prizes and Contacting Winners
- The winner or winners will be selected in the manner specified in the relevant Competition Post.
- The winners will be announced no later than 5 days after the end of the competition, unless otherwise stated in the Competition Post. The winner may be contacted by comment, private message on Facebook or Instagram, or by another method specified in the Competition Post.
- The winner must respond to the Organiser's request and provide the information necessary for delivery of the prize within 7 calendar days of being contacted. If the winner fails to do so, their entitlement to the prize shall expire and the Organiser shall be entitled to select an alternative winner.
- The Organiser will never ask the winner to provide an account password, payment card details or to pay any fee as a condition for receiving the prize.
IV. Prizes
- The prizes offered in the competition and their number will always be specified in the relevant Competition Post.
- A prize cannot be exchanged for cash, nor may the winner request a different prize from the one specified for the particular competition, unless expressly stated otherwise by the Organiser.
- The prize is intended for the specific winner and may only be transferred to another person with the Organiser's consent.
- Prizes will be handed over to winners in person at the Organiser's registered office or sent to an address provided by the winner. The method of delivery may be specified in greater detail in the Competition Post.
- If a prize shipment is returned to the Organiser due to an incorrect address provided by the winner or because the shipment was not accepted, the winner will be invited to collect the prize from the Organiser's registered office. If the winner fails to do so within 7 days of the request, their entitlement to the prize shall expire unless otherwise agreed with the Organiser.
V. Rights and Obligations of the Organiser
- The Organiser is entitled to exclude from the competition any participant who fails to comply with the competition rules, acts fraudulently, dishonestly or contrary to good morals, uses fake accounts or automated tools, or otherwise interferes with the proper conduct of the competition.
- The Organiser shall not be responsible for incorrect or incomplete contact or delivery details provided by the winner or for failure to deliver the prize for reasons beyond the Organiser's control.
- The Organiser is entitled, for serious reasons, to amend, shorten, extend, suspend or terminate the competition early, in particular where its proper conduct is prevented by technical, security-related, legal or other circumstances that the Organiser could not reasonably foresee or influence.
- Any amendment to the rules will be published in the same or a similar manner as the original competition rules. Any amendment must not, without reasonable grounds, adversely affect rights already acquired by participants.
- The Organiser reserves the right not to award the prize or to select an alternative winner if it is subsequently established that the originally selected winner failed to meet the competition conditions.
VI. Processing of Personal Data
- The controller of the personal data of competition participants is WINNER GROUP-WG, s.r.o., Company ID: 26788357, with its registered office at Žihla 997, 739 91 Jablunkov.
- Participants' personal data are processed only to the extent necessary for organising and evaluating the competition, verifying compliance with the conditions of participation, contacting winners and delivering prizes.
- The personal data processed may include, in particular, the participant's first and last name, username or profile on Facebook or Instagram, the content of the competition entry or comment and, in the case of a winner, also their e-mail address, telephone number and delivery address where necessary for delivery of the prize.
- The legal basis for processing personal data is the necessity of processing for participation in the competition, its proper conduct and the fulfilment of the Organiser's obligations towards participants pursuant to Article 6(1)(b) of Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR). Where the Organiser is required to retain personal data under applicable law, the legal basis shall also be compliance with a legal obligation pursuant to Article 6(1)(c) GDPR.
- Providing the personal data necessary for participation in the competition and, where applicable, delivery of the prize is voluntary; however, without providing such data, participation in the competition or delivery of the prize may not be possible.
- Personal data will be retained for the duration of the competition and thereafter only for the period necessary to complete and settle the competition, deliver prizes, protect the Organiser's legal claims and comply with any applicable legal obligations.
- Personal data obtained in connection with the competition will not be used for sending commercial or marketing communications without a separate legal basis or the participant's separate consent.
- As the competition takes place via Facebook or Instagram, certain personal data are also processed by the operators of these platforms in accordance with their own terms and privacy policies.
- Subject to the conditions set out in the GDPR, the participant has, in particular, the right of access to their personal data, the right to rectification or erasure, restriction of processing and, where applicable, the right to data portability and the right to lodge a complaint with the Czech Office for Personal Data Protection (Úřad pro ochranu osobních údajů).

VII. Participant Content and Final Provisions
- Competition entries, comments, photographs or other content submitted by participants must not be unlawful, vulgar, pornographic, discriminatory, hateful, offensive or otherwise contrary to good morals or the rules of the platform on which the competition takes place.
- The Organiser is entitled to exclude from the competition any competition content that is contrary to these rules.
- If a participant submits their own photograph, video or other copyrighted content as part of the competition, they grant the Organiser a non-exclusive and royalty-free right to use such content to the extent necessary for conducting and evaluating the competition and announcing its results, unless otherwise stated in the Competition Post.
- The Organiser shall not be responsible for outages or technical problems affecting Facebook, Instagram, internet connections or other third-party services beyond its control.
- The Organiser shall be liable for damage or other harm only to the extent provided for by applicable law. Nothing in these rules excludes or limits any rights of participants which cannot be excluded or limited under applicable law.
- By participating in the competition, the participant confirms that they have read these General Rules and the conditions specified in the relevant Competition Post and agrees to comply with them.
- Legal relationships arising in connection with the competition shall be governed by the laws of the Czech Republic.
These rules shall enter into force on 21 August 2026.
